I. SUBJECT MATTER OF THE GENERAL TERMS AND CONDITIONS
1.1. These general terms and conditions set out the rules for using the website mladenwinery.com.
1. 2. The website mladenwinery.com is owned by „Dracia“ EOOD, UIC 118043216, with its registered office and business address at: 1 Osogovo Street, Tutrakan.
II. GENERAL PROVISIONS
2. The website of Mladenova Izba Winery presents the activities, history and products of the company, and enables users to purchase wine and other goods via the online shop, book wine tours and subscribe to the e-newsletter.
3. The website may contain links to other websites. Mladenova Izba Winery accepts no responsibility for the privacy policies of websites it does not administer, nor for any other information contained therein.
4.1. Mladenova Izba Winery regularly updates the content and accessibility of the website to ensure the best possible user experience. Mladenova Izba Winery reserves the right to make any changes it deems appropriate to the website and therefore cannot guarantee uninterrupted, timely and error-free access to the entire website at all times. Where necessary, and with a view to maintaining and improving the quality and security of the website, Mladenova Izba Winery may temporarily (either as a planned measure or on an ad hoc basis) restrict access to it.
4.2. Mladenova Izba Winery accepts no liability for malfunctions, bugs or faults relating to external modules that are managed and controlled by external websites.
5.1. Mladenova Izba Winery accepts no liability for any loss or damage suffered, or loss of profit incurred, by users of the website as a result of the actions of a third party who has used unethical technical means to access information on the website. Mladenova Izba Winery does, however, guarantee that it uses the means at its disposal to prevent any such actions.
5.2. Mladenova Izba Winery may pursue legal action against any person who has carried out an attack by any means whatsoever against the Mladenova Izba Winery website, whether against its technical infrastructure or against the published content (illegal copying, hacking, sending malicious files, etc.).
III. E-NEWSLETTER
6. Mladenova Izba Winery is entitled to send customers who have registered for the service an e-newsletter containing information on the latest news, promotions and offers relating to the winery’s activities and the online shop.
IV. ONLINE SHOP
7. Via the online shop on the website mladenwinery.com The retailer, Mladenova Izba Winery, enters into sales contracts with customers for the delivery of wine and other goods. To this end, customers may:
(i) make electronic declarations in connection with the conclusion or performance of contracts with the seller via the online shop’s interface;
(ii) examine the goods, their characteristics, prices and delivery terms;
(iii) enter into contracts for the sale and purchase of the goods offered by the seller in the online shop;
(iv) make payments in connection with the contracts concluded in accordance with the payment methods supported by the online shop.
Order
8.1. An order is any individual request sent to Mladenova Izba by a customer to purchase goods from the online shop. An order may be placed via the online shop’s interface, by email or by telephone. Mladenova Izba confirms receipt of the order by email or by calling the telephone number provided by the customer.
8.2. By ticking the box to accept the general terms and conditions when placing an order, the customer declares that they are familiar with the content of these general terms and conditions, and states that they accept them and undertake to comply with them.
8.3. Acceptance of the general terms and conditions by ticking the relevant box, as well as the submission of an order by clicking the relevant button and the confirmation of each individual order, constitute electronic declarations within the meaning of the Electronic Document and Electronic Signature Act and result in the conclusion of contracts between the parties – MLADENOVA IZBA and the customer.
8.4. By placing an order, the customer declares that the personal data provided (name, telephone number, email address and delivery address) are accurate and complete, and gives their express consent for such data to be processed by MLADENOVA IZBA in accordance with the Privacy Policy.
8.5. By using the MLADENOVA IZBA online shop on the website mladenwinery.com You declare and warrant that you are at least 18 years of age. MLADENOVA IZBA reserves the right to refuse an order if there is any doubt that the customer in question is under 18 years of age.
9. MLADENOVA IZBA reserves the right to refuse to fulfil an order placed by a customer, if the contact details provided by the customer are incomplete and/or incorrect, or if, in the case of an online payment, the transaction is not accepted by the card-issuing bank or the funds are not credited to the seller’s account. Mladenova Izba undertakes to notify the customer of the order’s cancellation, where possible. In the event of order cancellation, neither party shall be entitled to claim compensation from the other.
Payment
10.1. All prices of goods in the MLADENOVA IZBA online shop are in euros (€) and include VAT. The prices quoted for individual items do not include delivery costs.
10. 2. The final amount, comprising the price of the goods and the delivery charges, is to be paid by the customer:
(i) by debit or credit card online via a module provided by an external payment service provider; or;
(ii) to the courier company delivering the goods, payable on delivery upon receipt of the goods (only for deliveries to an address within the Republic of Bulgaria).
Delivery
11.1. Delivery of the ordered goods is carried out by a courier company appointed by MLADENOVA IZBA. The goods ordered are delivered by a courier company to the address specified by the customer within the Republic of Bulgaria or within the European Union.
11.2. The delivery charge is set by the courier company depending on the delivery address. For orders of bottles totalling over 60 euros, delivery within Bulgaria is free of charge.
11.3. Orders for goods placed via the online shop are processed within 3 (three) working days of the order being received.
11.4. The goods ordered shall be delivered to the delivery address specified by the customer against the signature of the customer or a third party who accepts them and confirms their receipt on behalf of the customer. Should the customer not be present at the address provided by them within the delivery timeframe specified in the courier company’s general terms and conditions, or should the customer fail to ensure the conditions necessary for the handover of the goods within that timeframe, MLADENOVA IZBA shall be released from its obligation to deliver the ordered goods. Should the customer express a wish to receive the goods after the delivery period has expired, they shall bear all costs associated with the redelivery.
12.1. The customer is entitled to refuse to accept the goods they have ordered at the time of delivery, where the goods delivered clearly do not correspond to those ordered and this can be established upon a routine inspection, or where the goods have been damaged in transit. After receiving the goods, the customer is entitled to request their return only if they subsequently discover defects that could not have been detected upon a routine inspection. Mladenova Izba shall not be liable in the event that the characteristics of the goods deviate from those specified by the manufacturer or distributor, where the latter is a third party.
12.2. Where the customer refuses to accept or return the goods in the circumstances specified, the customer may request in writing from MLADENOVA IZBA that the goods delivered to them be replaced with goods in accordance with the agreement, or that the full amount paid by them be refunded within 30 (thirty) days. Goods may only be returned if they are in their original, undamaged condition.
12.3. In the event of an unjustified refusal by the customer to accept or return the goods ordered, the customer shall be liable for the costs of delivery and return. In such cases, the customer shall be liable to MLADENOVA IZBA for compensation for the losses incurred and the loss of profit resulting from the unjustified refusal.
13.1. A customer who is a consumer within the meaning of the Consumer Protection Act is entitled, without being liable for compensation and without giving any reason, to withdraw from the contract for the purchase of goods from MLADENOVA IZBA within 14 (fourteen) days from the date of receipt of the ordered goods.
13.2. The customer may exercise their right under paragraph 1 by sending a written notice to MLADENOVA IZBA to withdraw from the contract.
13.3. In the cases referred to in paragraph 1, the customer is obliged to return the goods ordered to MLADENOVA IZBA in their original condition within a period of no later than 14 (fourteen) days, from the date on which the customer notified MLADENOVA IZBA of their decision to withdraw from the contract, and, until the goods are returned, to store them and ensure that their quality and safety are maintained. MLADENOVA IZBA shall refund the customer the full amount paid by them no later than 30 (thirty) days from the date on which the customer exercised their right to withdraw from the contract. The customer shall bear the direct costs of returning the goods.
13.4. The right of withdrawal under paragraph 1 may not be exercised in respect of sealed goods which have been unsealed following delivery, nor in respect of goods which, by their nature, are liable to deteriorate or have a short shelf life.
Others
14.1. All goods are sold whilst stocks last, even if this is not expressly stated on the MLADENOVA IZBA online shop.
14.2. MLADENOVA IZBA reserves the right to amend the range, description and prices of the goods offered in the online shop, as well as delivery charges and payment methods. Each individual order is fulfilled at the prices and under the other terms and conditions expressly stated at the time the relevant order is placed.
15. The email address and telephone number provided in the online order form will be used by MLADENOVA IZBA to contact the customer. Any messages sent to the customer at the specified email address shall be deemed to have been received upon their arrival in the customer’s email inbox, without the need for explicit confirmation.
16. MLADENOVA IZBA takes care to ensure that the information regarding the availability of goods in the online shop is always up to date and accurate. In the event that MLADENOVA IZBA is unable to fulfil an order due to the goods ordered being out of stock, within 24 (twenty-four) hours of the order being placed, Mladenova Izba shall notify the customer concerned that their order cannot be fulfilled. In this case, MLADENOVA IZBA shall refund any amounts paid by the customer, if any, or amend the order at the customer’s request.
17. MLADENOVA IZBA shall not be liable for any delay in accepting or for the non-acceptance of orders placed where this is due to circumstances beyond its control. Individual orders shall become binding between the parties once the availability of the goods ordered has been verified and following confirmation by MLADENOVA IZBA of the order’s acceptance by sending a message via email or to the telephone number provided by the customer.
V. WINE TOURS
18.1. MLADENOVA IZBA offers its customers the opportunity to take part in wine tours, which can be booked on the website mladenwinery.com.
VI. PRIVACY POLICY
19. MLADENOVA IZBA collects, stores and processes personal data in accordance with its Privacy Policy, which you should familiarise yourself with.
VII. INTELLECTUAL PROPERTY
20.1. The website mladenwinery.com and all its content are subject to intellectual property rights, protected under current Bulgarian and applicable international legislation.
20.2. MLADENOVA IZBA holds the intellectual property rights to the website in its entirety, as well as to all its individual components (including logos, trademarks, photographs, video clips, texts, drawings, graphics, presentations, etc.), and its content may not be used by third parties without the express written consent of the copyright holder.
VIII. OTHER TERMS AND CONDITIONS
21.1. Where necessary, MLADENOVA IZBA reserves the right to unilaterally amend and/or supplement these general terms and conditions. Any amendments and/or supplements to these general terms and conditions shall be published on the website mladenwinery.com.
21.2. Any amendments and/or additions to these general terms and conditions shall not affect the legal relationship between MLADENOVA IZBA and the customer that arose prior to the relevant changes.
22. MLADENOVA IZBA shall not be liable for any pecuniary or non-pecuniary damage, losses or loss of profit suffered by the customer in the event of the customer’s failure to comply with these general terms and conditions or for other reasons reasons beyond the control of MLADENOVA IZBA.
23. MLADENOVA IZBA accepts no liability for any infringement of third parties’ rights resulting from the customer’s actions, including the customer’s use of another person’s identity details.
24. In the event of dissatisfaction with the online shop or the goods offered on it, MLADENOVA IZBA encourages its customers to contact a company representative directly, using one of the contact options listed below, in order to attempt an informal resolution of any disputes that may have arisen. Should the customer not wish to use this method or be dissatisfied with Mladenova Izba’s response, the customer may refer the matter to the Online Dispute Resolution (ODR) platform.
